Terms of Service

1. The Agreement

Welcome to nɛb.raɪ.ə Campfire (the “Service”), operated by Nebriae LLC (“we,” “us,” “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility & Account

You must be at least 13 years old to use the Service. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under your account.

3. Community Standard (PG Space)

Campfire is designed to be a respectful, reflective, and PG environment. You agree not to post, upload, transmit, or otherwise make available any content that violates these standards.

  • No harassment: bullying, intimidation, threats, or targeted abuse.
  • No hate: hate speech, discriminatory slurs, or dehumanizing content.
  • No explicit content: sexual content, pornography, sexual solicitation, or nudity intended to arouse.
  • No graphic imagery: gore, extreme violence, exploitation, or disturbing content.
  • No excessive profanity: vulgar or obscene language that disrupts a PG space.
  • No illegal activity: promotion of illegal acts or instructions for wrongdoing.
  • No malicious behavior: malware, phishing, doxxing, or attempts to compromise accounts/systems.

This is a private platform, not a public forum. We may remove content that violates these Terms or undermines the intended environment, even if the content is not illegal.

4. Your Content (“Signals”)

The Service allows you to create and store content such as journal entries, star finds, morse messages, images, and comments (collectively, “Signals”). You retain ownership of your Signals.

By posting Signals to the Service, you grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and transmit your Signals solely as necessary to operate and provide the Service (for example: showing your journal content back to you, or displaying a shared Signal to another user when you choose to publish/share it).

5. Moderation & Enforcement

We reserve the right (but not the obligation) to review, remove, restrict, disable, or delete Signals or accounts that violate these Terms or undermine the Service’s safety and tone. Enforcement decisions are made at our sole discretion.

  • Content removal or visibility restriction.
  • Temporary suspension or permanent termination.
  • Rate-limiting, blocking, or other abuse prevention measures.

6. Reporting Abuse

The Service may include in-product reporting tools. If you believe content violates these Terms, report it. Repeated false reports intended to harass others may result in enforcement action against the reporter.

7. Content Protection & Interface Deterrents

To reduce unauthorized extraction of user content, the Service may include interface-level deterrents (for example: disabling right-click context menus, limiting selection behavior, or blocking certain keyboard shortcuts). These measures are intended to discourage casual copying and scraping and help protect user Signals.

8. Strong Prohibition on AI Training, Scraping, and Dataset Use

NO AI TRAINING / NO DATASET CREATION: You may not use any content from the Service (including Signals, text, images, audio, or metadata) to train, fine-tune, evaluate, or improve any machine learning or AI model, or to build datasets for those purposes, without our express prior written permission.

  • No scraping, crawling, harvesting, or automated extraction of content.
  • No reproduction or redistribution of user Signals outside the Service.
  • No use of the Service to compile datasets, embeddings, vector indexes, or training corpora.
  • No “research,” “benchmarking,” or “model evaluation” using Service content without permission.

We may employ technical measures to detect and block automated access and may pursue legal remedies for violations, including injunctive relief.

9. Intellectual Property

The Service and its original content, features, and functionality (excluding your Signals) are owned by Nebriae LLC and are protected by intellectual property laws. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Service except as explicitly permitted by us in writing.

10. DMCA Takedown Procedure

If you believe content on the Service infringes your copyright, you may submit a DMCA notice to:

Your notice should include: (a) your contact information, (b) identification of the copyrighted work, (c) identification of the allegedly infringing material and where it appears, (d) a statement of good-faith belief, (e) a statement under penalty of perjury that the notice is accurate and you are authorized to act, and (f) your signature (typed is acceptable). We may remove content in response to valid notices.

11. Subscriptions & Billing

Certain features may be billed through the Apple App Store or other platform providers. Billing and refunds are handled by those providers under their terms. We do not store your payment card details.

12. Disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Nebriae LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING FROM YOUR USE OF THE SERVICE.

14. Indemnification

You agree to indemnify and hold harmless Nebriae LLC from and against any claims, damages, liabilities, losses, and expenses arising out of your Signals, your use of the Service, or your violation of these Terms.

15. Arbitration & Class Action Waiver (IMPORTANT)

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

You and Nebriae LLC agree that any dispute arising out of or relating to these Terms or the Service will be resolved through binding individual arbitration, rather than in court, except that either party may seek injunctive or other equitable relief in court for alleged infringement or misuse of intellectual property or unauthorized scraping/extraction.

No class actions: You and Nebriae LLC agree that disputes will be brought only in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

Opt-out: You may opt out of arbitration by emailing legal@nebriae.com within 30 days of first accepting these Terms, with your username and a clear statement that you wish to opt out.

16. California CCPA Language

California residents may have rights under CCPA/CPRA. Requests related to access, deletion, or information about the handling of personal data may be submitted to privacy@nebriae.com. We do not sell personal information in the conventional sense.

17. Governing Law

These Terms are governed by the laws of California, United States, without regard to conflict of law rules, except where federal law controls.

18. Termination

We may suspend or terminate access to the Service at any time for violations of these Terms or to protect the Service and users. Upon termination, your right to use the Service will cease immediately.

19. Changes

We may modify these Terms. If changes are material, we will post the updated Terms and revise the Effective Date. Continued use of the Service constitutes acceptance of the updated Terms.
